How is the Law of Interfaith Marriage?

Marriage is a phase in life. Everyone, of course, wants to have a legal and legal life partner by getting married. Today many couples are getting married of different religions. So, how is the law for interfaith marriage according to the Islamic view and also according to the laws in force in Indonesia?

The Law of Marrying Different Religions in Islam

The law of interfaith marriage is explained in Islam through the arguments of the holy verses of the Qur'an and Hadith. In the Qur'an itself it is stated in the letter Al-Baqarah: 221

وَلَا تَنْكِحُوا الْمُشْرِكَاتِ حَتَّى يُؤْمِنَّ وَلَأَمَةٌ مُؤْمِنَةٌ خَيْرٌ مِنْ مُشْرِكَةٍ وَلَوْ أَعْجَبَتْكُمْ وَلَا تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُؤْمِنٌ خَيْرٌ مِنْ مُشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَئِكَ يَدْعُونَ إِلَى النَّارِ وَاللَّهُ يَدْعُو إِلَى الْجَنَّةِ وَالْمَغْفِرَةِ بِإِذْنِهِ وَيُبَيِّنُ آيَاتِهِ لِلنَّاسِ لَعَلَّهُمْ يَتَذَكَّرُونَ

"And do not marry polytheist women until they believe. Verily, a believing slave woman is better than a polytheist woman, even though He attracts your heart. And do not marry the polytheists (to believing women) until they believe. Verily, a believing slave is better than a polytheist, even though He attracts your heart. they invite to hell, while Allah invites to heaven and forgiveness by His permission. And Allah explains His verses (His commandments) to people so that they may take lessons."

In this verse it is absolutely explained that it is forbidden to marry a polytheist woman or in the sense of a different religion for men. Likewise for Muslim women who are also prohibited from marrying non-Muslim men, which is strengthened by the letter Al-Mumtahanah: 10

لَا هُنَّ حِلٌّ لَهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ

"They are not lawful for the disbelievers and the disbelievers are not lawful for them."

The Law of Marriage of Different Religions According to Ulama

Most scholars agree that the law of interfaith marriage is haram except for the people of the book (Jews and Christians). However, nowadays it is very difficult and even almost impossible to find Jewish and Christian scribes who hold fast to the teachings of Prophet Moses with the Torah and Prophet Isa with the true Bible. So it can be concluded that it is impossible to carry out interfaith marriages.
In Indonesia, several religious organizations such as MUI, NU, Muhammadiyah also have fatwas and their views on interfaith marriage. MUI issued a fatwa that the law of interfaith marriage is haram considering that there are too many mafsadat compared to the benefits.
NU and Muhammadiyah have also followed in the footsteps of MUI in deciding the law on interfaith marriage by issuing a fatwa prohibiting and haram to marry interfaith by referring to the holy verse of the Qur'an Surah Al-Baqarah: 221.

Law of Interfaith Marriage According to Indonesian Law

Marriage in Indonesia is legally regulated as stated in Law (UU) Number 1 of 1974 concerning Marriage which reads:

"Marriage is valid, if it is carried out according to the law of each religion and belief"

In addition, it is also stated that Article 8 letter f of the Marriage Law states that marriage is prohibited if religious rules prohibit it as well as other applicable regulations. Based on the Marriage Law mentioned earlier, we can conclude that legally marriage follows the religious teachings of the party who will carry out the marriage or marriage.

Marriage administration is contained in Law Number 24 of 2013 concerning Amendments to Law Number 23 of 2006 concerning Population Administration. Which in the Act explains that interfaith marriages are allowed administratively with some notes such as following the Marriage Law.
The Ministry of Religious Affairs (KUA) which has the authority to process administratively if it has been declared religiously legal, according to the religious rules adopted by the prospective bride and groom.
So, in other words, specifically for Muslims, they must be of the same faith so that they are declared Islamically valid so that they can be registered with the Ministry of Religious Affairs (KUA).

Conclusion

Interfaith marriages are often pros and cons in social life for Muslims and as Indonesian citizens. Religious diversity in Indonesia creates interactions between religious communities which then creates opportunities for interfaith marriages.

Following the rules that apply in Indonesia that marriage is regulated in the Marriage Law which states that marriage is considered valid if it is in accordance with applicable teachings. If the one who is married is a Muslim/Muslim, it is in accordance with Islamic teachings that it is forbidden to marry a non-Muslim as has been explained through the arguments of the Holy Qur'an and the fatwas of the existing scholars.

Therefore, a Muslim must marry only fellow Muslims. Wallahua'lam.
